Class Action on behalf of a group of businesses
“Marda Loop Main Streets” Construction Initiative
Napoli Shkolnik Canada has commenced a proposed class action lawsuit on behalf of a group of businesses located in the Marda Loop district of Calgary, alleging significant financial hardship resulting from the City of Calgary’s ongoing infrastructure project.
The “Marda Loop Main Streets” construction initiative, which began in June 2023 and was originally scheduled for completion by the summer of 2024, has experienced substantial delays and remains ongoing. The Representative Plaintiffs, Silver Sage Beef and Diner Deluxe, along with other class members, assert that the City’s mismanagement of the project has caused continuous and severe disruption to business operations.
Business Grievance Allegations
The affected businesses claim that specific grievances including restricted access, traffic congestion, limited parking, and unsafe pedestrian pathways have led to a significant decline in customer traffic and business operations. The plaintiffs contend that these conditions have resulted in layoffs, business closures, and a deterioration of commercial dealings, leaving many enterprises struggling to remain viable.
The claim further alleges that the City owes a duty of care to ensure reasonable and safe access to affected businesses and to mitigate the undue economic harm. These allegations have not yet been proven in court; however, the matter is currently before the Case Management Justice for certification purposes.
